The US Department of Agriculture (USDA) has withdrawn a proposed rule to amend the US standards for grades of table grapes (European or Vinifera Type).

The proposed revision, published in the 26 February 2008 Federal Register, would have created an additional allowance of 5 per cent for shattered berries in consumer containers for shipments that are en route or at destination.

The comments that USDA’s Agricultural Marketing Service had received indicated conflicts over the marketability and subsequent shrink due to the changes in packaging, and the effect the proposal would have on individual businesses.

In addition, AMS noted a lack of independent data to clarify the issue and no clear consensus among industry segments to support the proposed rule. Therefore, AMS has determined not to proceed further with this action.

The notice of withdrawal was published in the 18 May 2009 Federal Register.
